Second habeas corpus filed by RPK’s lawyers

Internal Security Act (ISA) detainee Raja Petra Kamarudin (RPK) has filed a second habeas corpus applicati on at the Kuala Lumpur High Court.

His wife Marina Lee Abdullah said the legal team had submitted the application today.

“This application is totally different from the first one,” she said when contacted.

“Whereas the first detention order meant he would be detained for up to 60 days, the second said he can be detained in there for life.”

A writ of habeas corpus orders the authorities to produce detainees before a judge to determine whether the government has the right to continue holding them.

The first application filed on Sept 16 was against the popular blogger’s initial detention under Section 73(1) of the ISA, which allows the police to detain a person deemed to be prejudicial to national security for a maximum of 60 days for interrogation.

On the eve of the hearing on Sept 23, however, the Home Ministry signed another order - this time under Section 8 - before packing RPK (left) off the next day to the Kamunting detention camp in Perak.

Section 8 provides for a detention period of two years, renewable upon the minister’s discretion.

Public prosecutors, therefore, had then argued that the application had been rendered moot by the modified section under which Raja Petra was held.

Decision still pending

In his blog posted earlier today, Raja Petra’s lawyer Malik Imtiaz Sarwar noted that the first application to review Home Minister Syed Hamid Albar’s detention order against Raja Petra under Section 73(1) is still pending.

“The judge has to make a decision whether to strike it out for being academic. As we see it, it is not, as the detention order issued by the minister was based on the recommendations of the police,” said Malik.

“The order issued by the minister flowing from the earlier detention by the police, we take the view that the validity of the earlier detention is of relevance to the question of whether RPK is currently being legitimately detained.”

The point will be further argued on Oct 28.

Malik said further that a date has yet to be fixed for the hearing for the second habeas corpus application.

“We expect to know only after Hari Raya,” he said.

Raja Petra, who has become a cause celebre for his scathing attacks against high government leaders, has been detained ostensibly for writing articles that were deemed sensitive to Muslims.

A Malaysian Murder Trial to Nowhere

And, despite what looked like a routine case in which abundant physical evidence and one confession would be enough for a guilty verdict, the trial of her three accused murderers has been droning on for nearly 18 months. As the trial grinds on as it has for months, the elephant in the courtroom remains the deputy prime minister, Najib Tun Razak, who along with his wife, Rosmah Mansor, has so far escaped questioning or being called as a witness despite two statutory declarations and other evidence linking them to the dead woman. The questions over Najib’s involvement, or lack of it, are growing in urgency because he is now on track to become the country’s prime minister after Prime Minister Abdullah Ahmad Badawi designated him last month as his successor. The three standing trial are Abdul Razak Baginda, a 48-year-old former advisor and close friend of Najib’s, and two of Najib’s bodyguards, who were part of an elite unit specializing in protecting top political figures. The latest twist is a set of text messages between Najib and Shafee Abdullah, who was represents Razak Baginda, according to an October 11 report on the website Malaysia Today, whose editor, Raja Petra Kamaruddin, currently is standing trial on sedition charges for accusing Najib of being part of the plot to kill Altantuya. In one piece, Raja Petra accused Rosmah of having been present when Altantuya was murdered. She has denied the charge and offered to sue Raja Petra. One message from Shafee to Najib said: "We provided (the police) everything, including old PDAs and notebooks and a couple of bills. Nothing incriminating." Malaysia Today said the exchange raises questions if anything "incriminating" was kept from the police. Malaysia Today also suggested that that the message exchange may indicate that Najib had abused his powers as deputy prime minister to interfere with the investigation. Najib subsequently denied that he had abused his power, told reporters the messages are "private" and refused further comment. "Why do I need to comment? There is no abuse of power," the deputy prime minister told local reporters. ""Why should it be of major concern? The important thing is if there is abuse of power and, if you read it carefully, there is no abuse of power, period." In any case, whatever the new revelations may be, Najib and Rosmah have remained above it all, gracing functions and appearing in feel-good articles in the government-controlled local media, dishing out platitudes on unity, friendship, integrity and economic management. Those who exposed the more gruesome aspects of the trial like Raja Petra Kamarudin, editor of Malaysia Today, and P Balasubramaniam, a private investigator hired by Baginda to keep watch on Altantuya, have come under scrutiny. In addition to the sedition charge, Raja Petra is facing charges of criminal defamation for publishing articles on the murder while Bala has gone into hiding after being pulled into a police station to hurriedly retract a statutory declaration which, among other things, claimed that Baginda told him that Najib introduced Altantuya to him in a diamond exhibition in Hong Kong and that she enjoyed anal sex.

Local bloggers are the most vociferous champions of Altantuya. One wrote a gruesome fictional first-person account of how Altantuya may have experienced the murder.

The local media, on the other hand, have buried stories on the murder trial to the inside pages and commentaries calling for justice are rare.

The usual reason given for editors for shying away from the issue is that it is subjudice although occasionally photographs of Najib holding a machine gun or detonating a bomb, and Rosmah aiming a rifle are published in relation to stories on the Defence Ministry, which Najib also heads.

Najib has been widely reported to have been involved as defense minister in a series of unsavoury purchases of submarines, jet fighter planes and other armaments on which individuals close to him, including Razak Baginda, and the United Malays National Organisation earned vast “commissions.” There is strong circumstantial evidence that Altantuya was the translator on at least one of the series of transactions involving the submarine purchases.

There are other questions over how somehow Abdul Razak was allegedly able to involve Najib’s bodyguards in the murder without Najib’s knowledge. Abdul Razak reportedly spoke with Najib’s chief of staff to ask for someone to “do something” about Altantuya, who was harassing him for money after he attempted to end their affair. One of the two bodyguards confessed to the murder, but the confession was stricken, allegedly because the statement wasn’t cautioned. Numerous amounts of other evidence have been tossed out in the marathon case, raising suspicions that the proceedings are being drawn out to prepare for either acquittals or diminished sentences for the three, perhaps to keep them from pointing the finger at Najib.

Now the former premier, Mahathir Mohamad, has come to Najib's defence. He told The Star on Oct 18, that there is a "concerted effort" to demonise Najib. "“I faced all that before. I was labelled many things and was accused of everything," Mahathir said, referring to the countless allegations levelled against him, including fomenting judicial corruption, since he retired.

Najib & Rosmah must not avoid this issue. People form the likes of Asia Sentinel that repeatedly linked Najob & Rosmah to the murder MUST be taken to task and in this case by Najib & Rosmah to court to stop all this nonsense. WE do not want our future PM and his wife to be accused of being a murderer or linked to a murder! Bad enough they were LINKED to corrupt practices! SUE THEM BABY!!!! SUE THEM NOW!!!!

Commentary

OCT 14 - No one has answered the million ringgit question yet: Is the SMS exchange on the Altantuya murder case between Datuk Seri Najib Razak and a prominent lawyer authentic?

If it is not, then it should be put down as yet another move by critics of the government to discredit the man slated to be the next prime minister of Malaysia; dismissed as another desperate attempt to implicate Najib in
the murder of Altantuya Shariibuu.

If it is authentic, then the disclosure raises a whole host of questions. How did private and confidential SMS records of two individuals reach the public domain? Was Najib interested in the case because his advisor Abdul Razak Baginda was a central figure? Was there something sinister or inappropriate in any of the exchanges between Najib and Datuk Shafee Abdullah?

Did Najib use his position as the DPM to interfere in the progress of the murder investigation or did he merely make a few telephone calls to find out the gravity of the situation facing his friend?

Nobody in the government has said anything since the SMS exchange was posted on Malaysia Today, the website owned by Raja Petra Kamaruddin, the blogger who is being detained under the Internal Security Act.

Prime Minister Datuk Seri Abdullah Badawi’s attempt to protect his number two was clumsy.

At a press conference yesterday, a journalist from a local daily broke the monotony of questions on the economy by asking the Prime Minister his thoughts on the SMS. Abdullah, either because he did not catch the question or because he wanted to stay on message and only speak on the economy, ignored the reporter. Later on, he walked up to the reporter and sought a clarification on the question.

The reporter elaborated a bit more on the SMS exchange between Najib and Shafee. The press conference was reconvened and Abdullah defended Najib.

“I can't believe Datuk Seri Najib wants to abuse power. If he's the one who is inclined to abuse power, then how could he be my successor? I believe in him, I believe he's a good person and he would be a good prime minister, “ said Abdullah.

The problem with this stout defence of his deputy is that it does not answer the most important question swirling out there today: Is the SMS exchange between Najib and Shafee authentic?

Continuing silence on this matter will not help Najib or the Abdullah administration. Continued silence on this matter will also create paranoia on the strength of firewalls and security measures of Malaysia’s telcos.

Raja Petra to be arrested and charged tomorrow (Thursday)

Raja Petra Kamarudin has been ordered to report to the ninth floor IPK KL (opposite Pudu Jail) at 10.00am tomorrow (Thursday, 17 July 2008).

According to the police, Raja Petra is to be charged for criminal defamation with regards to the Statutory Declaration that he signed on 18 June 2008.

It is not known yet which court he will be charged in as the Attorney-General has not decided yet.

RPK Refuses To Expose Informant On Altantuya Murder

Raja Petra, who gave a statement to the police on the matter at the Sentul Police Headquarters Saturday afternoon, said he refused to expose the source of his information as he feared for the informant's safety.

Raja Petra, who arrived at the police station at 5.10pm accompanied by his wife, Marina Abdullah and lawyer Amarjit Singh, left about two-and-a-half hours later at 7.45pm.

He said that the police informed him that he was being investigated under Section 203 of the Penal Code following a police report lodged by the Attorney-General's Chambers on June 20 alleging that he had made a false declaration.. . . . more

THE CORRIDORS OF POWER

I said in an earlier article in this same column that Prime Minister Abdullah Ahmad Badawi should be out of office by Christmas. And his successor, I predicted, could either be Deputy Prime Minister Najib Tun Razak, aspirant Tengku Razaleigh Hamzah, or opposition head honcho Anwar Ibrahim. I have also always said that seven days is a long time in politics. What more seven months. And the fact that political fortunes change, subject to both internal as well as external factors beyond your control, means that the situation is always very fluid indeed.

Soon after the 12th General Election of 8 March 2008, the pressure mounted, not only for Abdullah to resign, but also for him to confirm his exit plan with details such as his resignation date and the name of his successor. The pressure, in fact, started in mid-2006 when Tun Dr Mahathir Mohamad first launched his salvo against Abdullah at a dialogue session in Kelab Century Paradise jointly-organised by Malaysia Today and a couple of NGOs. For almost two years Mahathir continued his attacks on Abdullah, interrupted in between by a couple of heart attacks and a heart operation.

Abdullah was up against two fronts -- internally from the Najib and Tengku Razaleigh forces and externally from Pakatan Rakyat led by Anwar Ibrahim. Of course, Pakatan Rakyat did not really pose that much a threat until after the general election when it managed to grab five states and 82 Parliament seats -- which resulted, for the first time, in Barisan Nasional losing its two-thirds majority in Parliament. It did happen once before, of course. But, then, it was the Alliance Party of Umno, MCA and MIC that lost its two-thirds majority -- but they managed to regain their majority when Barisan Nasional was formed and all the opposition parties except DAP joined the new coalition (although PAS left the coalition almost three years later and has remained in the opposition ever since).

There is another internal force, a fifth column, which is headed by Muhyiddin Yassin. But Muhyiddin has been very cautious in not openly siding with any of the three factions of Abdullah, Najib and Tengku Razaleigh. He is very cleverly building up his support base, which can later swing to any of the three factions depending on who has the best chance of winning. In that sense, Muhyiddin can play the role of kingmaker if he so wishes and in the event he feels he can never make it on his own unless he joins forces with Abdullah, Najib or Tengku Razaleigh.

Muhyiddin is no direct threat. He will only become a threat if he manages to build up enough support and then throws this support behind one of the three contenders. And that contender will most certainly be the candidate who has the best chance of winning. But then, who is it the contender that has the best chance of winning? That is something that is very fluid and keeps changing week to week.

By mid-June 2008, it appeared like Najib and Anwar were the two hot favourites. When Najib visited the Umno divisions, the grass-root members cheered him and ‘proclaimed’ him the new Umno President cum Prime Minister. This even happened in Abdullah’s own division. And Muhyiddin, who was there by his side, was cheered as the new Umno Deputy President -- although he feigned ‘shyness’ in typical Malay fashion. It looked like Najib was set to become the new Umno President with Muhyiddin as his running mate, which means they will be Malaysia’s new Prime Minister and Deputy Prime Minister respectively.

Anwar Ibrahim - will he be the next PM?

But then this will only happen if Anwar does not pull a coup. Anwar had boldly proclaimed many times that he will form the new federal government by Malaysia Day, 16 September 2008, and that at least 30 Barisan Nasional Members of Parliament are waiting in the wings and ready to cross over. The race was on. Either Najib pushes Abdullah out before 16 September or else he will be pushing Abdullah out just to become the opposition leader in Parliament and not the Prime Minister of Malaysia.

It was now either Najib or Anwar. And there was also Tengku Razaleigh and Muhyiddin to contend with, though not as potent as Najib and Anwar. Tengku Razaleigh and Muhyiddin are not too serious a problem, though problems nevertheless. It was Najib and Anwar who have to be dealt with, and dealt with before the Umno branch elections start this month and the division elections in August.

Suddenly, Najib and Anwar are facing controversy -- Najib with his Altantuya murder controversy and Anwar in a new sodomy allegation. Now Najib and Anwar have their hands full. They are busy clearing their names and have no time to worry about taking over the Prime Ministership. The issue is no longer which of the two can become the next Prime Minister but whether they can even stay out of jail. That is a more pressing problem. The job of Prime Minister will have to wait.

Smooth transfer of power - Najib as PM?

Saiful, the man who alleged that Anwar had sodomised him met Najib just before he lodged that police report against Anwar. At first Najib denied meeting the young man. Then, later, he admits that he did meet the chap after all, but only to discuss the young man’s career and future and to help him obtain a scholarship.

The earlier denial followed by the later admission does not augur well for Najib. The fact that a very busy Deputy Prime Minister has all the time in the world to meet a school dropout so that he can act as the latter’s career guidance counselor is also a story many find hard to buy. Events and statements point to the fact that Najib is behind this latest sodomy allegation against Anwar.

That, at least, is what we are being led to believe. But what we have not been told is that Saiful was trained by the BTN (Biro Tata Negara), Malaysia’s propaganda outfit and an outfit headed by Abdullah loyalists. We are told that Saiful first surfaced a week or so before the 8 March 2008 general election when he reported to PKR’s party HQ as an election volunteer. Where did he come from and who brought him into the party HQ?

Yes, that is the most crucial question. Saiful did not just turn up on the doorstep of the party HQ from nowhere. He was brought in by his very close friend, the son of the late Dato Nasaruddin Jalil and an Anwar aide. That’s right. According to Dato Nasaruddin’s wife, her son and Saiful are bosom buddies. Then, something strange happened. Dato Nasaruddin’s son was mysteriously killed by a hit-and-run driver. No one knows how it happened or who killed him. But, after that most tragic ‘accident’, Saiful stayed on to become one of the temporary staff of the party.

Was Dato Nasaruddin’s son’s death an accident? Is there something more sinister than just an unsolved hit-and-run accident? I suppose we shall never know the answer to that one and it may forever remain in the books as an accident or a victim of a hit-and-run. But what we do know is that the young man whom Dato Nasaruddin’s son brought into the party got elevated from a volunteer to a temporary staff of the party.

The Muftis of Perlis and Perak have suggested that Anwar come out and swear an oath that he is innocent of the allegation of sodomising Saiful. That would be the only way he can clear his name. It is not known yet if he will do that but, if he does not, then the dark cloud hanging over his head will remain there. There would be no other way that Anwar can clear his name.

Anwar also has to explain what he was doing at that upmarket condo. Yes, I too have clandestine meetings with my many Deep Throats at secret locations such as hotel rooms and apartments. But then I always bring along witnesses to ensure that I have an alibi in the event someone spots me and accuse me of having secret rendezvous for purposes of sex.

But Anwar’s case is more complex. I was told they have photographs of Anwar and Saiful going into one of the rooms of the One World hotel escorted by another man. If these photographs surface and Anwar cannot explain what is going on, then he may cease to be a threat to Abdullah. Abdullah then has only to take care of Najib.

The Statutory Declaration (SD) by the private investigator, Bala, has hurt Najib a lot. But the retraction or second SD the following day, which deletes all references to Najib, is even more damaging than the first one. If anyone had any doubts and thought that maybe Bala was fixing Najib up with his first SD, the second SD removed those doubts. Now, people are even more convinced that Najib is guilty. If not then why amend the first SD but only as far as Najib’s name is concerned whereas all the other allegations remain the same?

Bala’s first SD was not done in a hurry. It took numerous meetings over two months to finalise the SD. Bala had plenty of time to change his mind over those two months. And how can you say that you signed the SD under duress when it was done over many meetings over two months?

But the second SD was done only a few hours after the first one surfaced. And it was done after his visit to the police station. That gives an appearance of duress. And the fact he does not say that the entire SD is false but only as far as Najib’s name is concerned gives an impression that Najib is behind the second SD and that it was done to clear his name. Why would Najib go to all this trouble if he were innocent?

I met Bala on 2 July 2008 and was with him for about six hours from 6.30pm. He was jovial and chatty and joked that my SD two weeks earlier had stolen the thunder from his. Now, his has become the second SD instead of the first as he had hoped. After the press conference of 3 July 2008 we had lunch and he was still as jovial and chatty as the night before. He was now the superstar and he was relishing every minute of it. We agreed to meet on Saturday night (tonight) to party and celebrate the ‘success’ of his SD. Then, yesterday, the bombshell.

In one swoop, both Najib and Anwar are brought down. And this means Abdullah has now rid himself of two serious problems. Raja Petra Kamarudin has been asked to report to the Sentul Police Station at 5..30pm today, Saturday, 5 July 2008.

He received a phone call from ACP Aziz that the police want to record his statement in relation to the Statutory Declaration he signed on 18 June 2008.

No, Abdullah Badawi was not talking about the people named in the Statutory Declaration (read it here). He was referring to the latest sodomy allegation against Anwar Ibrahim. “He will definitely deny it. That is common for someone who has been accused." Yes, but is this common only to Anwar Ibrahim? Would not Abdullah Badawi, his son-in-law, Najib, Rosmah, Col. Aziz and Col. Norhayati not also do the ‘common’ thing and also deny what was alleged in the Statutory Declaration?

Hmm….but did not Abdullah Badawi also say last week that he believes his Deputy Prime Minister Rosmah Mansor and her husband, Najib, are innocent? Well, he said this at least as far as Rosmah and her husband are concerned. But when it comes to Anwar Ibrahim he says, "The police are the ones who will determine whether the report is true or not. It is not something that we can determine. He will definitely deny it. That is common for someone who has been accused."

Abdullah Badawi has already ‘locked’ the police investigation and this will force the police to arrive at only one verdict. It is now impossible for the police to rule any other way other than declaring that the Statutory Declaration is false. That would be the only way to save the Prime Minister’s face and insulate him from controversy, or worse, from criminal charges.
